Introduction

This site contains information related to the products and services of Idea Crossing, Inc. ("we", "us" or "our") related to Skild®, our adaptable software platform for professional challenge organizers used to design and operate competitions, award programs, contests and innovation challenges. This privacy policy concerns your privacy when you use this site.

Browser Information

When you enter this site, information is gathered from your Internet browser. This information may include your IP address (which allows us to determine the identity of your Internet service provider), your operating system and the type of browser software that you are using to access this site. This information allows us to upgrade this site as necessary to optimize its efficiency. All information obtained from your browser is anonymous, and no personal information is ever transmitted to us in this manner.

Cookies

We may use cookies to collect information about how you use this site and the services, products and information on this site. A "cookie" is a small text file that a Web site can place on your computer's hard drive in order, for example, to retain your preferences or registration information for your next visit to such Web site. Personal Information

Our customers may collect personal information from the participants in the competitions, award programs, contests and other events that our customers sponsor using our software platform (“Customer Information”). Customer Information is stored on our servers to allow us to provide our services to our customers.

Sharing of Personal Information

Within our company, we limit access to any personal information we collect to authorized individuals. We may disclose personal information to affiliated and unaffiliated third parties who work with us on marketing, product development, service enhancement and other similar matters, provided they contractually agree to the same level of protection as set forth in this Policy, and to limit their use of the data to the specified services provided on our behalf. These third parties include the sponsors for any competitions, award programs, contests or innovation challenges we offer. Customer Information is used and shared solely to provide our services to our customers and for no other purpose.

Data Retention

We will retain your personal information only for as long as reasonably necessary for the purposes described in this Policy. We may continue to retain and use aggregated or anonymized data derived from personal information, provided such data cannot be used to identify any individual. Please be aware that we may also be required to retain your personal information for purposes of complying with legal, tax and accounting obligations.

EU, United Kingdom, and Swiss Data Privacy Principles

Skild complies with the EU-U.S. Data Privacy Framework (EU-U.S. DPF) and the UK Extension to the EU-U.S. DPF, and the Swiss-U.S. Data Privacy Framework (Swiss-U.S. DPF) as set forth by the U.S. Department of Commerce.  Skild has certified to the U.S. Department of Commerce that it adheres to the EU-U.S. Data Privacy Framework Principles (EU-U.S. DPF Principles) with regard to the processing of personal data received from the European Union and the United Kingdom in reliance on the EU-U.S. DPF and the UK Extension to the EU-U.S. DPF.  Skild has certified to the U.S. Department of Commerce that it adheres to the Swiss-U.S. Data Privacy Framework Principles (Swiss-U.S. DPF Principles) with regard to the processing of personal data received from Switzerland in reliance on the Swiss-U.S. DPF.  If there is any conflict between the terms in this privacy policy and the EU-U.S. DPF Principles and/or the Swiss-U.S. DPF Principles, the Principles shall govern.  To learn more about the Data Privacy Framework (DPF) Program, and to view our certification, please visit https://www.dataprivacyframework.gov/.

Types of EU, United Kingdom, and Swiss Personal Data Collected. Our participation in the Data Privacy Framework Principles applies to all personal data that is subject to this privacy policy and is received from the European Union and European Economic Area (“EU Personal Data”), United Kingdom, and Switzerland. We will comply with the Data Privacy Framework Principles with respect to all EU, United Kingdom, and Swiss Personal Data.

Purposes of EU, United Kingdom, and Swiss Personal Data Collection and Use. We will only process EU , United Kingdom, and Swiss Personal Data (as detailed in Collection of Personal Information) in ways that are compatible with the purpose for which we collected the EU, United Kingdom, and Swiss Personal Data, or for purposes that the individual or entity providing the EU, United Kingdom, and Swiss Personal Data later authorizes. Before we use your EU, United Kingdom, and Swiss Personal Data for a purpose that is materially different than the purpose for which it was collected or that you later authorized, we will provide you with the opportunity to opt out. We maintain reasonable procedures to help ensure that EU, United Kingdom, and Swiss Personal Data is reliable for its intended use, accurate, complete, and current.

Disclosures for National Security or Law Enforcement. Under certain circumstances, we may be required to disclose your EU, United Kingdom, and Swiss Personal Data in response to valid requests by public authorities, including to meet national security or law enforcement requirements.

Access Rights. You may have the right to access the EU, United Kingdom, and Swiss Personal Data that we hold about you and to request that we correct, amend, or delete it if it is inaccurate or processed in violation of the Data Privacy Framework Principles. These access rights may not apply in some cases, including where providing access is unreasonably burdensome or expensive under the circumstances or where it would violate the rights of someone other than the individual requesting access. If you would like to request access to, correction, amendment, or deletion of your EU, United Kingdom, and Swiss Personal Data, you can submit a written request to us as provided in the “Contact Us” section below. We may request specific information from you to confirm your identity. In some circumstances we may charge a reasonable fee for access to your information. We will provide an individual opt-out choice before we share their data with third parties other than our agents, or before we use it for a purpose other than which it was originally collected or subsequently authorized. To limit the use and disclosure of your personal information, you may submit a written request to privacy@skild.com.

Data Transfers to Third Parties. Our accountability for EU, United Kingdom, and Swiss Personal Data that we receive under the Data Privacy Framework Principles and subsequently transfer to a third party is described in the Data Privacy Framework Principles. In particular, we remain responsible and liable under the Data Privacy Framework Principles Principles if third-party agents that we engage to process EU, United Kingdom, and Swiss Personal Data on our behalf do so in a manner inconsistent with the Principles, unless we prove that we are not responsible for the event giving rise to the damage.

Questions or Complaints. In compliance with the EU-U.S. DPF and the UK Extension to the EU-U.S. DPF and the Swiss-U.S. DPF, Skild commits to resolve DPF Principles-related complaints about our collection and use of your personal information.  EU and UK individuals and Swiss individuals with inquiries or complaints regarding our handling of personal data received in reliance on the EU-U.S. DPF and the UK Extension to the EU-U.S. DPF, and the Swiss-U.S. DPF should first contact Skild at privacy@skild.com.

Alternative Dispute Resolution.  In compliance with the EU-U.S. DPF and the UK Extension to the EU-U.S. DPF and the Swiss-U.S. DPF, Skild commits to refer unresolved complaints concerning our handling of personal data received in reliance on the EU-U.S. DPF and the UK Extension to the EU-U.S. DPF and the Swiss-U.S. DPF to BBB National Programs DPF Services, an alternative dispute resolution provider based in the United States. If you do not receive timely acknowledgment of your DPF Principles-related complaint from us, or if we have not addressed your DPF Principles-related complaint to your satisfaction, please visit https://bbbprograms.org/programs/all-programs/dpf-consumers/ProcessForConsumers for more information or to file a complaint.  The services of BBB National Programs DPF Services are provided at no cost to you.

Additionally, we have further committed to refer unresolved privacy complaints under the Data Privacy Framework Principles to an independent dispute resolution mechanism, the BBB National Programs Dispute Resolution Process, operated by BBB National Programs. If you do not receive timely acknowledgment of your complaint, or if your complaint is not satisfactorily addressed, please visit https://privacyshield.bbbnp.org/complaint for more information and to file a complaint. This service is provided free of charge to you. 

Please note that if your complaint is not resolved through these channels, under limited circumstances, a binding arbitration option may be available before a Data Privacy Framework Principles Panel.

We are subject to the investigatory and enforcement powers of the U.S. Federal Trade Commission (FTC).

Unsolicited E­mail

Should you voluntarily provide your personal information to us, you may receive periodic e­mail messages from us. Such messages may include announcements regarding this site, the services, products and information on this site or our company more generally.

Security Precautions

Where appropriate, we may employ firewalls, encryption technology, user authentication systems and access control mechanisms to control access to our systems and data. However, you should exercise discretion with respect to the submission of any personal information to this site. Transmitting information via the Internet is never completely secure and, therefore, any information submitted may be intercepted, collected, used or disclosed by others.
